Terms of use.
The conditions governing your use of Betplanners: a statistical analysis tool, not betting advice.
- Betplanners is a statistical tool: predictions are never guarantees.
- You must be 18 or older, with one account per person.
- Paid plans are billed monthly through Stripe and renew automatically; we notify you before each renewal and you can cancel anytime.
- You have 14 calendar days to withdraw from your subscription, without giving any reason.
- You are responsible for your own decisions and any outcomes.
01Acceptance of terms
By accessing and using Betplanners, you agree to be bound by these Terms of Use. If you do not agree, please do not use the platform.
02Eligibility
- You must be at least 18 years old to use the platform.
- One account per person. Multiple accounts may be terminated.
- You must provide accurate information when registering.
03Description of service
Betplanners is a statistical analysis platform offering football match predictions based on historical data. The service includes probability calculations, prediction tracking, a competitive ranking system and calculation tools built on those probabilities, among them one that prices combinations of several selections you choose.
04Your account
You are responsible for maintaining the security of your account and for all activity under it. Notify us of any unauthorised use.
05Subscriptions and payments
- Paid plans (Starter and Professional) are billed monthly through Stripe.
- If your sign-up includes a free trial period, we tell you its exact length before you subscribe. When it ends, the subscription continues automatically as a paid plan unless you cancel first. The free trial is one per person and per payment card: if the card you sign up with was already used for a trial on another account, the subscription starts without a trial and the first charge is made when you subscribe.
- The subscription renews automatically for periods equal to the one you contracted. Before each renewal we email you at least 15 days in advance, stating the date and the amount, so you can cancel if you do not wish to continue.
- If your sign-up includes a trial period, we send you the conversion notice on the day of activation, in its own message, and you will also receive a reminder before the first charge.
- You may cancel at any time. Access continues until the end of the period already paid for, and you are not charged again.
- Prices are listed in EUR and include applicable taxes (VAT). If we change the price of your plan, we will tell you at least 30 days in advance and you may cancel without penalty before it takes effect.
- Beyond the right of withdrawal in section 06 (which has its own deadline and procedure and does not depend on our assessment), any other refund request is considered case by case.
06Right of withdrawal
Applicable law
Betplanners is offered internationally. Whatever law governs these Terms, if you contract as a consumer you keep the mandatory protection rules of your country of residence. In the European Union the withdrawal period is harmonised at 14 calendar days by Directive 2011/83/EU; in Spain it is set out in Royal Legislative Decree 1/2007. Outside the Union other periods may apply: in Brazil, for instance, article 49 of the Consumer Protection Code sets 7 days. We apply 14 calendar days to every user, whatever their country, because that meets or exceeds the periods of the legal systems cited. If the mandatory law of your country of residence grants you a longer period, that period prevails.
Your right
You have 14 calendar days from the conclusion of the contract to withdraw from your subscription, without giving any reason and without penalty. The contract is concluded when you sign up, including when the sign-up carries a free trial period.
How to exercise it
It is enough to tell us your decision unequivocally. You can use the withdrawal form in your account, or write to contact@betplanners.com. We will acknowledge receipt on a durable medium, stating the refund deadline.
Effects
We will refund the payments received within 14 calendar days of learning of your decision, using the same payment method you used. If you requested the immediate start of the service (see the next clause) and had already begun to enjoy it, you will pay only the amount proportionate to the service actually supplied up to the moment of your communication. If you withdraw during the trial period, you will have paid nothing and the withdrawal gives rise to no payment or refund. If you withdraw after the first charge and within the deadline, we will refund the amount charged, deducting only the proportionate part of the billing period elapsed between the charge and your communication, calculated on the price of that period.
Express request for immediate start
Before payment we ask you to tick a specific box: in it you request that the supply of the service begin immediately, within the withdrawal period, so that you can use the platform from day one. That request is not bundled into your acceptance of these Terms, and without ticking it the sign-up does not complete.
This request does not affect your right of withdrawal, which you keep in full for the 14 calendar days. Its only two effects are that you have the service from day one and that, should you withdraw, you will pay only the part proportionate to what you actually used.
Under article 103.a) of the aforementioned Act, you declare that you are aware that the right of withdrawal is extinguished once the contract has been fully performed. We expressly inform you that this does not occur in a subscription such as this one: the service is supplied on a continuous basis and is not fully performed within the withdrawal period, so your right remains in force throughout the 14 days.
07Acceptable use
You agree not to:
- Use automated tools to scrape or extract data from the platform.
- Attempt to reverse-engineer the probability calculation engine.
- Resell, redistribute, or commercially exploit any data obtained from Betplanners.
- Use the platform for any unlawful purpose.
08Nature of the service and conformity
Betplanners is a statistical analysis tool. What you are paying for is access to probabilities, comparisons, rankings and calculation tools built on them, computed by our model over historical and market data, in line with the methodology, the sources and the update frequency described in Methodology.
The service is in conformity when those calculations are generated and displayed as described and the platform is available. A probability is not a promise: the fact that an outcome to which we assigned a probability does not occur is not a defect of the service. Past results do not guarantee future results.
Betplanners publishes analysis and, in some pieces, its own selection including specific bets. That selection is a general opinion based on our calculations and identical for every user: it is not personalised advice or guidance of any kind tailored to you, it is not adjusted to your personal circumstances or your financial situation, which we neither know nor collect. Publishing it guarantees no outcome. The decision to bet money, and how much, is exclusively yours.
Betplanners is not a gambling operator. We do not organise or accept bets, we do not act as an intermediary with bookmakers, and we do not hold user funds. What we provide are statistical calculations about sporting events. If you intend to use this information for betting, do so only with operators licensed in your jurisdiction, and read our responsible gaming page first.
Some tools work out what a combination of selections you choose is worth. There we do not select: we calculate, from our probabilities, the joint probability and the fair odds that correspond to what you ticked, and the difference against what the market pays. That calculation describes what the combination is worth according to our model; it is not a recommendation to place it, and the decision to bet money, and how much, remains yours.
Nothing above limits the rights the law grants you as a consumer in the event of lack of conformity of the service.
09Ranking and automated accounts
The ranking may include automated accounts operated by Betplanners, whose predictions are generated by our model rather than submitted by a user. They are scored under the same rules as everyone else, are not eligible for any prize, reward or promotion, and are not subject to the one-account-per-person rule above. The ranking should therefore not be read as a table of human users only.
10Liability
We are liable to you, as provided by law, for damage caused to you by our breach. We do not exclude or limit our liability for wilful misconduct or gross negligence, for personal injury, or in any case where the law does not allow liability to be excluded or limited.
We are not liable for losses arising from your bets or from other decisions you make using the information on the platform: as stated in the Nature of the service section, those decisions are yours and their outcome depends on chance and on factors outside our service. In any event, we are only liable for damage that was foreseeable at the time of contracting and that is a necessary consequence of our breach (article 1107 of the Spanish Civil Code).
If the service is unavailable or not in conformity, you may require it to be brought into conformity, a proportionate reduction of the price for the affected period or, in the cases provided by law, termination with a refund.
If you do not contract as a consumer, our total liability is limited to the amount you have paid us in the twelve months preceding the event giving rise to the claim, except in cases of wilful misconduct or gross negligence.
11Intellectual property
The platform, its prediction models, the calculations it produces, its code and its presentation are the intellectual property of Betplanners. Raw sporting data (fixtures, results, line-ups and match statistics) comes from third-party sources, is not owned by us, and is shown for informational purposes.
You retain ownership of the predictions you save. By turning on your participation in the ranking you authorise us to display your username and your rating in the public leaderboard; that participation is off by default and you can turn it off again at any time from your account.
12Changes to these Terms
We may amend these Terms for valid reasons: legal or regulatory changes, changes to the service or its features, security reasons or the correction of errors. We will tell you by email at least 30 days in advance, stating what changes and from when. For paid subscribers, substantial changes take effect at the first renewal after the notice; until then the terms you accepted apply. If you do not agree, you may cancel without penalty before that date, keeping access until the end of the period you paid for.
13Termination
We may provisionally suspend or terminate your account if you breach these Terms. If termination follows a serious breach on your part, the current period is not refunded. In any other case of termination by us, we will refund the proportionate part of the period you paid for and did not use. All of this is without prejudice to your legal rights. Upon termination, your data will be deleted in accordance with our Privacy Policy.
14Complaints
If something has gone wrong, write to contact@betplanners.com with your username and what happened. We will acknowledge receipt and reply as soon as we can. Betplanners is not signed up to the Spanish consumer arbitration system, so if you are not satisfied you may turn to the consumer authorities of your region or country of residence, and in any event to the competent courts. If your complaint is not resolved, in our reply we will point you to a competent alternative consumer dispute resolution body, without prejudice to your right to turn to the consumer authorities and to the courts.
15Governing law
Betplanners is established in Spain and these Terms are governed by Spanish law, in particular Royal Legislative Decree 1/2007 (the consolidated text of the General Act for the Protection of Consumers and Users). This choice does not deprive a consumer of the protection afforded by the mandatory provisions of their country of habitual residence; in the European Union, pursuant to article 6 of Regulation (EC) 593/2008.
